Mazda Lemon Law – Airbag Recall

Mazda North American Operations will recall almost 700 recently-built vehicles after a manufacturing error created malfunctioning curtain airbags.

The manufacturer notified the National Highway Traffic Safety Administration (NHTSA) on June 25, 2018 they will recall 682 2018 Mazda CX-5 SUVs built between April 11 and April 27, 2018.

The affected vehicles contain curtain airbags that can unfold improperly during deployment. This can increase passenger injury risk when the curtain airbag deploys during a side impact or rollover event.

Mazda’s recall chronology cited an “inappropriate manufacturing process” at supplier Ashimori Industry Co. as the defect’s cause. The company stated they learned on April 26, 2018 that a certain curtain air bag’s base fabric didn’t meet adhesion specification. Mazda stopped vehicle shipments and deliveries involving affected vehicles, and worked with the supplier to determine what vehicles were sold containing suspect airbags.

The company’s Quality Audi Committee decided to conduct a safety recall on June 21, 2018.
Mazda will notify owners and dealers will replace the curtain air bags free of charge. The recall will begin in July 2018. Owners may contact Mazda customer service at 1-800-222-5500, Option 4. Mazda’s number for this recall is 2718F. Concerned consumers can also visit the NHTSA’s website and enter their VIN to see if their vehicle is included in any recalls.

Your vehicle’s manufacturer is legally required to fix any recalled problems for free. If the dealership refuses to fix the part or tries to charge you for the repair, contact the manufacturer immediately. The Highway Safety Act of 1970, which created the NHTSA, requires car manufacturers to pay for the recall and replacement of a defective part.

If the manufacturer fails to repair, replace, repurchase, or provide your recalled vehicle’s loss value, they are violating the warranty and a lawyer may be able to assist you. Lemon law attorneys help their clients by dealing directly with the manufacturer on the clients’ behalf, working to promptly resolve the issue and get their clients back on the road. Thanks to the Magnuson-Moss Warranty Act, attorneys can seek their fees directly from the manufacturer, meaning a client can obtain legal counsel without having to pay attorneys’ fees directly out of pocket.
