Nissan North America will recall roughly 400 vehicles with potentially leaky brake master cylinders.

The manufacturer notified the National Highway Traffic Safety Administration (NHTSA) a safety recall report on Jan. 31, 2018 stating they will recall 415 2015-2017 Nissan Juke Nismo RS vehicles built between July 6, 2015 and Jan. 30, 2017.

The affected vehicles can contain out-of-specification brake master cylinders. The cup seal inside the master cylinder housing can twist and not seat properly. This is caused by a combination of increased sliding resistance between the cup seal and piston because of brake booster negative pressure and dry conditions between the master cylinder piston. This can deteriorate sealing performance, letting brake fluid leak from the master cylinder into the brake booster.

Nissan first learned about the problem in December 2017 from the overseas market. The manufacturer began its investigation alongside component supplier TOKICO Automotive of Jiangsu, China. Both Nissan and the component manufacturer determined that while no such defects have been found in the U.S. market, the problem could affect those vehicles.

The manufacturer decided to conduct a safety recall campaign on Jan. 29, 2018.

Nissan will notify owners and dealers will replace the brake master cylinder free of charge. The recall is expected to begin March 19, 2018. Owners may contact Nissan customer service at 1-800-647-7261. Nissan owners can also visit the NHTSA’s website and enter their VIN to see if their vehicle is included in any recalls.

Your vehicle’s manufacturer is legally required to fix any recalled problems for free. If the dealership refuses to fix the part or tries to charge you for the repair, contact the manufacturer immediately. The Highway Safety Act of 1970, which created the NHTSA, requires car manufacturers to pay for the recall and replacement of a defective part.

If the manufacturer fails to repair, replace, repurchase, or provide your recalled vehicle’s loss value, they are violating the warranty and a lawyer may be able to help you. Lemon law attorneys assist their clients by dealing directly with the manufacturer on the clients’ behalf, working to promptly resolve the issue and get their clients back on the road. Thanks to the Magnuson-Moss Warranty Act, attorneys can seek their fees directly from the manufacturer, meaning a client can obtain legal counsel without having to pay attorneys’ fees directly out of pocket.
