Lemon Law News – Incorrect Airbag Software Prompts Jaguar Land Rover Recall

Lemon Laws Offer Jaguar Customers Relief

Jaguar Land Rover North America is recalling roughly 300 recently built cars over concerns surrounding their safety systems.

The manufacturer sent a safety recall report to the National Highway Traffic Safety Administration (NHTSA) on Feb. 15, 2018 stating they will recall 307 2018 Jaguar XF Sportbrake vehicles built between Oct. 13 and Dec. 14, 2017.

The manufacturer said they have found a potential issue involving the affected vehicles’ Supplementary Restraints System (SRS) calibration. Vehicles with said calibration issues may not properly protect occupants in certain low speed impact scenarios.

Jaguar Land Rover’s Product Safety and Compliance Committee first reviewed the problem on Jan. 16, 2018, following an engineering review that discovered incorrect software calibration. Further investigation found the 2018 Jaguar XF Sportbrake vehicles contained calibration software for the Jaguar XF Sedan.

Further testing revealed vehicles with the incorrect software may not properly deploy frontal airbags in low speed crash events. The company decided on Feb. 8, 2018 an unreasonable safety risk existed and initiated a recall.

Jaguar will notify owners, and dealers will update the software for the air bag system, free of charge. The recall is expected to begin April 6, 2018. Owners may contact Jaguar customer service at 1-800-452-4827. Jaguar’s number for this recall is H090.

Jaguar Land Rover owners can also visit the NHTSA’s website and enter their VIN to see if their vehicle is included in any recalls.

Your vehicle’s manufacturer is legally required to fix any recalled problems for free. If the dealership refuses to fix the part or tries to charge you for the repair, contact the manufacturer immediately. The Highway Safety Act of 1970, which created the NHTSA, requires car manufacturers to pay for the recall and replacement of a defective part.

If the manufacturer fails to repair, replace, repurchase, or provide your recalled vehicle’s loss value, they are violating the warranty and a lawyer may be able to assist you.

Lemon law attorneys help their clients by dealing directly with the manufacturer on the clients’ behalf, working to promptly resolve the issue and get their clients back on the road. Thanks to the Magnuson-Moss Warranty Act, attorneys can seek their fees directly from the manufacturer, meaning a client can obtain legal counsel without having to pay attorneys’ fees directly out of pocket.
