Lemon Laws Protect Motorcycle Customers

Harley-Davidson Motor Company will recall almost 200,000 motorcycles suffering from potentially dangerous brake problems.

The motorcycle manufacturer notified the National Highway Traffic Safety Administration (NHTSA) they will recall 174,636 2008-2011 Harley-Davidson Road King, 2008-2011 Harley-Davidson Road King Police, 2008-2011 Harley-Davidson Electra Glide Classic, 2008-2011 Harley-Davidson Electra Glide Ultra Classic, 2008 Harley-Davidson VROD, 2008 Harley-Davidson CVO Road King, 2008 Harley-Davidson Night Road, 2008-2010 Harley-Davidson Road King Classic, 2008-2009 Harley-Davidson Road Glide, 2009-2010 Harley-Davidson VROD, 2008-2009 Harley-Davidson Electra Glide Standard, 2008-2011 Harley-Davidson Street Glide, 2009 Harley-Davidson CVO Ultra Classic, 2009 Harley-Davidson CVO Road Glide 3, 2008 Harley-Davidson Night Rod Special, 2009-2011 Harley-Davidson Night Rod Special, 2009-2011 Harley-Davidson VROD Muscle, 2010 Harley-Davidson CVO Ultra Classic 5, 2010-2011 Harley-Davidson Electra Glide Ultra Limited, 2010 Harley-Davidson CVO Street Glide, 2011 Harley-Davidson Road Glide Ultra, 2010-2011 Harley-Davidson Road Glide Custom, 2011 Harley-Davidson Street Glide 103, 2011 Harley-Davidson Road King Classic 103, 2011 Harley-Davidson CVO Ultra Classic 6, 2011 Harley-Davidson Road Glide Ultra 103, 2011 Harley-Davidson CVO Road Glide Ultra, 2011 Harley-Davidson Road Glide Custom 103 and 2011 Harley-Davidson CVO Street Glide 2 motorcycles.

The manufacturer states an “elevated number” of these motorcycles did not have their DOT 4 brake fluid flushed in accordance with the specified 2-year maintenance cycle specified in the owner’s and service manuals, possibly because of owners not knowing how important regular brake fluid flushes are for their vehicle’s anti-lock brake systems.

Harley-Davidson’s testing shows if that brake fluid isn’t flushed according to schedule, braking issues can develop. The fluid can gel, forming deposits on brake components. If deposits form on the ABS Hydraulic Control Unit’s apply valve, the valve can stick.

Harley-Davidson will notify owners and dealers will flush the entire brake system with new Platinum Label DOT 4 brake fluid free of charge. The recall is expected to begin Feb. 12, 2018. Owners may contact Harley-Davidson customer service at 1-800-258-2464. Harley-Davidson’s number for this recall is 0171. Harley-Davidson owners can also visit the NHTSA’s website and enter their VIN to see if their vehicle is included in any recalls.

Lemon laws vary from state to state as to whether they cover motorcycles, but the federal Magnuson-Moss Warranty Act covers motorcycles regardless of state.

The manufacturer of your vehicle is legally required to fix any recalled problems for free. If the dealership refuses to fix the part or tries to charge you for the repair, contact the manufacturer immediately. The Highway Safety Act of 1970, which created the NHTSA, requires motorcycle manufacturers to pay for the recall and replacement of a defective part.

If the manufacturer fails to repair, replace, repurchase, or provide the loss value of your recalled vehicle, they are violating the warranty and a lawyer may be able to assist you.
