Mercedes-Benz Lemon Law – E400 Recall

Mercedes-Benz USA is recalling a small number of vehicles containing potentially defective child seat anchoring systems.

The manufacturer’s Jacksonville, Florida-based branch notified the NHTSA they will recall 39 2018 Mercedes-Benz E400 Cabrio and 2018 Mercedes-Benz E400 4Matic Cabrio vehicles built between Oct. 30 and Nov. 2, 2017.

The affected vehicles contain possibly incorrectly installed child seat anchoring systems called “ISOFIX consoles.” These consoles may partially detach from the car body in a crash, increasing injury risk.

Daimler AG, Mercedes-Benz’s parent company, stated in its recall chronology plant quality management discovered and reported deviations in ISOFIX console mounting in November 2017. Daimler AG engineers examined affected ISOFIX consoles in December 2017 and January 2018 for strength and durability, eventually determining the variances could compromise fastening strength. Engineers confirmed in May 2018 that the ISOFIX consoles could detach in a crash, and after determining an affected vehicle range Daimler AG states they could not rule out a safety risk.

Mercedes-Benz will notify owners and dealers will inspect the ISOFIX console and replace it if necessary, free of charge. The recall will begin October 3, 2018. Owners may contact MBUSA customer service at 1-800-367-6372. Mercedes-Benz owners can also visit the NHTSA’s website and enter their VIN to see if their vehicle is included in any recalls.

Your vehicle’s manufacturer is legally required to fix any recalled problems for free. If the dealership refuses to fix the part or tries to charge you for the repair, contact the manufacturer immediately. The Highway Safety Act of 1970, which created the NHTSA, requires car manufacturers to pay for the recall and replacement of a defective part.
