California Lemon Law

The California lemon law basically was originally designed to cover motor vehicles but one thing you need to know about the California lemon law is it not only covers motor vehicles but also covers basically any major consumer product. The California lemon law covers and see whose covers or abuse of covers motorcycles and covers a lot of things like I used to cover major appliances so long as there primarily for personal family or household uses.

So if anyone tells you that the California lemon law only covers vehicles and motor vehicles this is incorrect. Another thing know about California lemon law is it does cover used cars as well as new cars the only about the only thing to know about the used car loan law is a used car has to be sold with a warranty. If a used car is sold "as is" then the California lemon law does not cover that vehicle but a used car sold with a warranty or a certified used car would be covered by California lemon law.

Now what the California lemon law does is it let's you go to the manufacturer or to the selling dealer when you buy the defective car. I am gonna be Talking about cars, because usually its applied in the concept of cars. It lets you go to the manufacturer or dealer when you have an defect that they have not repaired within a certain number or the reasonable number of attempts and it lets you demand either a repurchase obviously a refund of your purchase money or replacement vehicle. That's where it allows you to demand as a consumer. Now, In pursuing a California lemon law claim there's a few things you need to know a lot of people contact me and they say do you necessarily mean four repair attempts within the first 12,000 miles because they had heard others require 4 repaired for the first 12,000 miles this is not a requirement of the California lemon law.

The California lemon law generally you need at least two repair attempts, obviously for more major issues like breaks or a major transmission problem to maybe three rigorous repair attempts can be sufficient for less serious problem you will probably need some more repair attempts. The repair attempts have to happen or at least start within the warranty period. If the warranty expires you can still have California lemon law rights but you will need to have started the repair process within the warranty period to fall under the California lemon law.

If you're a 50,000 mile warranty and the problem with your car doesn't occur until 60,000 miles that vehicle will not be covered by the California lemon law however lets say you have three rigorous hands-on transmission within the first 50 thousand miles in the warranty and then you have two more attempts after the warranty expires that case could qualify under the California lemon law.

So what you need to know as consumers is that you need a reasonable number of repair attempts at least two and a defect test within the warranty period. And you need to go back to it for a new car and you go back to the manufacturer and present it hard to the manufacturer for your California lemon law claim. For instance if you have a General Motors car don't take it to a ford dealership to do the repairs. If you have a General Motors warranty you take it to a General Motors dealership to do the repairs those are the things, the basic things you need to know about the California lemon law. If you hear that there's some absolute requirement that you don't have a lemon law claim if you don't have a certain number repair attempts within a certain number of miles that is not true. Anyway I hope this information has been useful to you and we look forward to reviewing your case and representing you.
